Tribu News, the company owning the Photoscout platform, provides a service for creating, printing, and mailing albums that compile your photos and messages. The content, including texts and photos, is uploaded to the platform by clients. The services offered by Tribu News encompass photo sharing through secure access, album creation, album printing, and the mailing of the printed version(s) via postal service.
By engaging with the platform through actions such as selecting « I agree » to these terms, completing the registration process, using the website in any capacity, or logging into the « Photoscout » site, you enter into a legally binding agreement with Tribu News without reservations.
It is strongly recommended that before using our services, you carefully read these terms and conditions along with all related documents, including the privacy policy.
Within these terms, all references to « you, » « your, » or « User » refer to the party using the Services or the Site, thereby entering into an agreement with Tribu News subject to these Conditions.
1. Eligibility.
By using the Services, you represent and warrant that: (A) all registration information you submit is truthful and accurate; (B) you will maintain the accuracy of such information; (C) you are fully capable and competent to enter into a binding agreement with Tribu News; (D) you have the authority to agree to these conditions on behalf of yourself and/or the entity you represent; and (E) your use of the Services does not violate any applicable law or regulation.
Tribu News reserves the right to terminate your account if it is believed any of these statements are untrue.
2. Registration.
2.1. To access the services, you need to create and register an account (« your account »), requiring information such as First Name, Last Name, and Email Address. Upon successfully creating your account, you will be considered a « member. »
2.2. You are responsible for all activities under your account.
2.3. You agree to immediately notify us of any unauthorized use of your account or any other breach of security related to your account or the website.
3. Content.
3.1. Definitions. « Content » includes text, files, design templates, images, photos, videos, sounds, works of authorship, and other materials. Your album contains content that you include and submit to Tribu News for printing and sharing services.
3.2. Ownership of Your Content. Tribu News does not claim ownership of your content; you retain full ownership. You represent and warrant that: (i) you own or have the right to grant the licenses set out in this section for the content you provide for our printing services to be printed in an album, and (ii) your album’s content does not infringe on the privacy rights, publicity rights, copyrights, or any other rights of any person or entity.
3.3. License to Print Your Albums. You grant Tribu News a non-exclusive, worldwide, fully paid, and royalty-free license to reproduce and distribute your content solely for the purpose of printing albums to be delivered to you and those you have allowed access to your account.
3.4. Your Content. You are solely responsible for any Content that is posted by or through your account on the services (including any content you may receive from third parties). Tribu News reserves the right to set limits on album archiving, including, but not limited to, the right to delete such data after a certain period.
3.5. Prohibited Content. You agree not to post or otherwise provide to the services any prohibited content. « Prohibited Content » includes any content that: (i) is offensive, pornographic, or promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual; (ii) bullies, harasses or advocates harassment, intimidation, or bullying of another person; (iii) is false or misleading or promotes, endorses, or furthers illegal activities or conduct that is abusive, threatening, obscene, defamatory, or libelous.
- Acceptance Policy
4.1. An order will be considered accepted upon your receipt of an order confirmation at the email address associated with the customer’s account.
4.2. Once an order confirmation is received, the order cannot be terminated or canceled by the customer unless covered by a special feature such as our « satisfaction guarantee. »
4.3. Despite the order confirmation, Tribu News reserves the right at any time after receiving your order to accept or refuse your order and to refund it.
4.4. We may require verifications or additional information before accepting any order.

5.1. Eligibility; Credit Card Terms. To order a subscription, you must be at least eighteen (18) years old or the age of majority applicable in your jurisdiction. You can pay for your order using the following payment methods (Visa, Mastercard, Bancontact, and SEPA).
- Delivery
6.1. Each account must have at least one delivery address.
6.2. All deliveries and printings are processed as quickly as possible, but the process may take between 3 to 7 business days.
6.3. Delivery Times. The delivery of the first edition will be made on a date communicated at the time of order. The delivery time includes the time it takes to prepare your order for shipping and the time required for delivery by the carrier. The delivery time may be extended when circumstances arise beyond our control.
6.4. Acceptance of Delivery. Upon delivery of the album, you must ensure it matches your order and is in good condition. In case of any problem, it is your responsibility to inform Tribu News of such a problem by email, within 3 business days. In all cases, you must include your contact information, as well as your order number. If your request is made more than 3 business days after your order’s delivery, or if the information is incomplete, we will not be able to process your feedback.
- User Conduct
7.1. You agree not to access or attempt to access the site by any means other than the interface provided by Tribu News or to circumvent access or usage restrictions put in place by Tribu News to prevent certain uses of the Site.
7.2. You commit to using the website and services in good faith and in compliance with these Terms and not to use, or to encourage others or permit others to use, the website to:
i. Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity;
ii. Access or use the website in a manner that could damage, disable, overburden, or impair any Tribu News server or the networks connected to any Tribu News server;
iii. Intentionally or unintentionally interfere with or disrupt the site or violate any laws related to the access or use of the website, violate any requirements, procedures, policies, or regulations of networks connected to the website, or engage in any activity prohibited by these Terms;
iv. Disrupt or interfere with the security of, or otherwise cause harm to, the website, accounts, passwords, servers, or networks connected to or accessible through the website or any affiliated or linked sites;
v. Disrupt or inhibit any other user from using and enjoying the website or other affiliated or linked platforms;
vi. Reproduce, sell, trade, resell or exploit for any commercial purposes, any portion of the website, use of the website, or access to the website;
vii. Defraud, defame, or otherwise violate the legal rights (such as rights of privacy and publicity);
viii. Use automated methods or tools to extract data from any part of the website without our prior written express permission (we may employ robot exclusion headers on the website, and you agree to comply with any such headers);
ix. Decrypt, disassemble, or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Site, except to the limited extent applicable laws specifically prohibit such restriction;
7.3. Furthermore, you agree to comply with all laws, regulations, and ordinances as a condition of using the services and/or the Site.
7.4. To allow us to protect the quality of our products and services, you consent to our employees and representatives accessing your account and records for any reason, at our sole discretion. We also reserve the right, but do not assume the responsibility, to monitor or review your conduct while using the Services and the Site. Your use of the Services and the website is subject to all applicable local and international laws and regulations. Additionally, you acknowledge that you are responsible for obtaining or providing all access lines, telephone, and computer equipment (including modem), or other devices, necessary to access the website, and for paying all fees related thereto.
7.5. You agree not to use the Services for any illegal activity, and Tribu News reserves the right to investigate any suspicious activity or in response to any reported complaint. When investigating such activity, Tribu News reserves the right to report any suspected illegal activity to any appropriate person or entity and to provide them with all relevant information, including personal data.
7.6. In the event that you notice an error in the transfer either sent or received as a result of using the Services, you must notify us immediately at info@mytribunews.com. If you notice that you have received a transfer beyond what you expected, you must immediately inform us in such a way that arrangements can be made for you to immediately return any overpayment.
8. Tribu News has the right (but not the obligation) to review any content and remove any content in the sole judgement of Tribu News that violates these Terms (3.5. prohibited content).
9. Copyright Policy.
9.1. Tribu News respects the intellectual property of others, and asks and expects our members to do the same. The policy of Tribu News is to terminate the membership of any member who infringes copyright upon prompt notification to Tribu News by the copyright holder or the copyright holder’s legal representative.
9.2. If you believe that your work has been copied and published on the Services or used in a manner that constitutes a copyright infringement, please provide us with the following information: (i) an electronic or physical signature of the person authorized to act on behalf of the copyright owner; (ii) a description of the work that you claim has been infringed; (iii) a description of the location on the service of the material that you claim is infringing; (iv) your address, telephone number, and email address; (v) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; (vi) a statement by you, made under penalty of perjury, that the information above in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
9. Copyright / Trademark Information. The website and its content, including site design, plans, drawings, illustrations, photographs, images, texts, graphics, etc. (the « Information ») are protected by the copyright laws of Belgium, international treaties, and copyright laws in other countries. The Information is the property of Tribu News or third parties who have allowed Tribu News to publish the copyright of the Information on the website. The user must not modify, copy, publish, distribute, broadcast, display, photocopy, license, produce derivative works from, or sell any part of the Information contained on the website without the prior written consent of Tribu News. The user acknowledges the copyright existing in the Information and agrees not to make commercial use of the Information or to change or modify the Information or any part of it.
10. Third Party Services.
10.1. You acknowledge and agree that Tribu News may engage third party partners and suppliers (printers, transport companies) in order to provide you with the Services.
10.2. By using our Services, you agree to be bound by the terms of use established by third party partners and suppliers that Tribu News engages with. This is in addition to the terms and conditions set forth in these terms.
10.3. By accepting the terms and conditions, you expressly acknowledge that Tribu News acts as an agent for the partner and that Tribu News has no responsibility for the actions or omissions of the third party partner.
11. Limitation of Liability. To the extent legally permitted by applicable law, Tribu News shall not be liable to you or any third party for any indirect, incidental, special, consequential damages, including damages, losses arising from your use of the services.
12. Indemnification. You agree to defend, indemnify and hold Tribu News, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the services in violation of these Terms and/or arising from a breach of any provision of these Terms.
